1. Acceptance
These Terms & Conditions ("Terms") govern your access to and use of the AffilFinder website, platform, APIs, scripts, and related services (collectively, the "Service") operated by AffilFinder LTD ("we", "us", "AffilFinder"). By using the Service—including by integrating our script, registering for our beta, or accessing our dashboard—you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Description of the Service
AffilFinder provides a geo-gated affiliate platform that (i) allows publishers to show sponsored offer overlays to visitors who are outside the publisher's service area (e.g. region-restricted content or products), and (ii) allows advertisers to list offers and receive qualified clicks from such blocked traffic. The Service includes geo-resolution (e.g. by IP), allowlist/blocklist configuration, event and click logging, reporting, and pay-per-click or other agreed commercial terms. We may offer a beta or limited release; features and availability may change.
3. Accounts and Registration
You may need to register or sign up for the Service (e.g. to join our beta). You must provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us promptly at legal@affilfinder.com of any unauthorized use.
4. Acceptable Use
You agree to use the Service only in compliance with these Terms and applicable law. You must not: (a) use the Service for any illegal or fraudulent purpose; (b) interfere with or disrupt the Service or our infrastructure; (c) attempt to gain unauthorized access to any part of the Service or other accounts; (d) use the Service in a way that violates third-party rights (including intellectual property or privacy); or (e) use the Service to send spam or malicious content. Publishers must ensure that their use of sponsored offers (including creatives and landing URLs) complies with their own policies and applicable regulations (e.g. advertising and gambling laws). Advertisers must ensure their offers and targeting are lawful in the relevant jurisdictions.
5. Intellectual Property
We and our licensors own all rights in the Service (including software, design, and branding). We grant you a limited, non-exclusive, revocable license to use the Service as provided and in accordance with these Terms. You do not acquire any ownership in the Service. Feedback you provide may be used by us without obligation to you.
6. Data and Privacy
Our collection and use of personal data is described in our Privacy Policy. You agree to our processing of data as described there. Where you provide us with end-user or other data, you represent that you have the necessary rights and consents to do so.
7. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties (express or implied), including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted or error-free operation, or that the Service will meet your specific requirements. Geo-resolution and targeting are based on available data and may not be 100% accurate.
8. Limitation of Liability
To the maximum extent permitted by law, AffilFinder LTD and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities, arising from or in connection with the Service or these Terms. Our total liability for any claims arising from or relating to the Service or these Terms shall not exceed the amounts actually paid by you to us in the twelve (12) months preceding the claim (or one hundred pounds sterling if no such payments have been made).
9. Changes
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated by email or a notice in the Service. Continued use of the Service after changes constitutes acceptance. If you do not agree, you must stop using the Service.
10. General
These Terms constitute the entire agreement between you and AffilFinder regarding the Service. They are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any provision is held invalid, the remainder remains in effect. Our failure to enforce any right does not waive that right.
